General Terms and Conditions (GTC)
of Umrah Smart UG (haftungsbeschränkt) as of: December 2025
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts concluded between Umrah Smart UG (haftungsbeschränkt) - hereinafter referred to as "Umrah Smart" or "Agent" - and the customer via the online platform https://www.umrah-smart.com.
Umrah Smart exclusively arranges travel services from third parties (e.g., flight tickets, hotel bookings, Umrah packages, visa services) and does not act as a tour operator, unless expressly stated otherwise.
2. Subject of the Contract
(1) Umrah Smart provides an online platform through which customers can book travel services from third-party providers. (2) The contract for the respective travel service is concluded directly between the customer and the respective service provider (e.g., airline, hotel, tour operator, visa service provider). (3) Umrah Smart merely facilitates the conclusion of these contracts and is not responsible for the provision of the arranged services themselves.
3. Mediation Service
(1) Umrah Smart undertakes to properly forward the customer's booking request to the respective service provider and to transmit all necessary documents (e.g., booking confirmation, travel documents). (2) Responsibility for the correct provision of the travel service lies exclusively with the service provider. (3) All information regarding prices, services, and availability is based on information from the respective providers; Umrah Smart assumes no liability for this, unless an incorrect statement is based on intentional or grossly negligent behavior by Umrah Smart.
4. Booking and Conclusion of Contract
(1) By submitting a booking request via the platform, the customer bindingly instructs Umrah Smart to arrange the selected travel service. (2) The mediation contract is concluded as soon as Umrah Smart confirms the booking. (3) The actual travel contract is formed upon acceptance by the respective service provider. (4) After a successful booking, the customer receives a confirmation email containing the service provider's contract data.
5. Prices and Payment Terms
(1) All prices stated on the platform are in Euro (€) including statutory VAT, unless otherwise stated. (2) Depending on the selected service, payment is made either directly to the service provider or via Umrah Smart as an agent in the name and for the account of the service provider. (3) Umrah Smart is entitled to charge a service fee for the mediation, which will be transparently displayed to the customer before the booking is completed. (4) Accepted payment methods include credit card, PayPal, Sofort transfer, or other methods offered on the website.
6. Cancellations, Rebookings, and Withdrawal
(1) The conditions for cancellations and rebookings are governed by the terms and conditions of the respective service provider. (2) Umrah Smart supports the customer in communicating with the service provider but is not liable for the service provider's decision regarding refunds or rebookings. (3) Umrah Smart may charge a reasonable processing fee for handling a cancellation or rebooking, provided this was communicated in advance.
7. Liability
(1) Umrah Smart is exclusively liable for damages resulting from its own breaches of duty under the mediation contract. (2) The respective service provider is exclusively liable for defects or performance disruptions of the arranged travel service. (3) Liability of Umrah Smart is excluded unless there is intent or gross negligence, or in the case of damages resulting from injury to life, limb, or health. (4) Liability for slight negligence exists only in the event of a breach of essential contractual obligations (cardinal obligations).
8. Information Duties according to § 651v BGB
Umrah Smart fulfills all information duties according to §§ 651a ff. BGB. Before the booking is completed, the customer is provided with all legally required information about the respective service provider and their terms and conditions.
9. Data Protection
The collection and processing of personal data takes place exclusively in accordance with applicable data protection laws, in particular the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG). 10. Online Dispute Resolution and Consumer Arbitration
The European Commission provides a platform for online dispute resolution (OS): https://ec.europa.eu/consumers/odr/
Umrah Smart is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
11. Applicable Law and Jurisdiction
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). (2) To the extent permitted by law, the place of jurisdiction for all disputes is the registered office of Umrah Smart. (3) For consumers, this place of jurisdiction only applies if the customer has no residence in Germany or moves their habitual residence abroad after the conclusion of the contract.
12. Severability Clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
